Terms of Service

1. Who we are
Xanawave is an internet radio hosting service operated by Numele firmei tale, Strada, cod poștal, oraș, Belgia, VAT BE0123456789. Contact: info@xanawave.com.
2. The service
We provide software and server capacity that lets you upload audio, schedule playlists and broadcast a continuous stream, together with a public listening page and related tools. Features available to you depend on the plan you choose.
3. Your account
You must give accurate registration details, keep your password secure, and be at least 18 years old or have the consent of a legal guardian. You are responsible for everything that happens under your account, including anything done by DJs or staff you invite.
4. Music licensing — your responsibility
We do not provide music licences. Broadcasting recorded music normally requires permission from rights holders and collecting societies in your country, for example SABAM and Simim in Belgium, or their equivalents elsewhere. Obtaining, paying for and reporting under those licences is entirely your responsibility.
By uploading content you confirm that you hold every right needed to broadcast it. We may ask you for proof of licensing and may suspend a station where rights are disputed.
5. Plans, payment and trials
Plans are billed monthly or yearly in advance. Free trials convert to a paid plan only if you choose one; if you do not, broadcasting stops when the trial ends, while your files remain available for a short period.
Prices are shown in euro and may exclude VAT depending on your status and country. We may change prices with at least 30 days' notice, effective at your next renewal.
6. Cancellation and refunds
You can cancel at any time from your dashboard; your plan then runs until the end of the paid period. Consumers in the EU have a 14-day right of withdrawal, which you waive for the part of the service already delivered once broadcasting begins. We do not refund partly used periods otherwise.
7. Limits and fair use
Storage, listener numbers, bitrate and station counts are set by your plan. We may throttle or suspend usage that threatens the stability of the platform for other customers.
8. Suspension and termination
We may suspend or close an account that breaches these terms or our acceptable use policy, that goes unpaid after the grace period, or where we are legally required to act. Where practical we contact you first. On termination we delete your content after 30 days.
9. Availability
We work to keep the service running continuously but do not guarantee uninterrupted broadcasting. Maintenance, provider incidents and events beyond our control may interrupt it.
10. Liability
To the extent permitted by law, our total liability in any twelve-month period is limited to the amount you paid us in that period. We are not liable for lost listeners, lost revenue or lost data beyond our backups.
11. Governing law
These terms are governed by Belgian law, and disputes fall to the competent courts of Belgium, without affecting mandatory consumer protections in your country of residence.
